Terms of Sale & Privacy Policy

Website: stateofmind.fr — Last updated: 1 July 2026

Welcome to State Of Mind. These Terms and Conditions ("Terms") govern your access to and use of the website stateofmind.fr (the "Site") and any purchase you make through it. By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms in their entirety. If you do not agree, please do not use the Site.

1. Seller Identity

The Site and the "State Of Mind" brand are operated by ALEGRIA, a French société par actions simplifiée (SAS) with its registered office at 36 Rue des Fontaines, 92310 Sèvres, France, registered with the Nanterre Trade and Companies Register under number 817 934 508 ("State Of Mind", "we", "us", "our").

Full company and publisher details are set out in our Legal Notice. For any question relating to these Terms or an order, please contact us via our Contact page.

2. Scope and Acceptance

These Terms apply to all sales of products (fragrances, discovery kits, diffusers, candles, room sprays, and related accessories, collectively the "Products") made through the Site, to any customer, whether a consumer or a business, located anywhere in the world, subject to the mandatory local consumer protection rules referenced in Section 15.

We reserve the right to modify these Terms at any time. The version applicable to your order is the one in force on the Site at the date you place that order.

3. Eligibility and Account

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order.

When creating an account, you agree to provide accurate, current, and complete information and to keep your login credentials confidential. You are responsible for all activity under your account.

We may suspend or terminate an account in case of suspected fraud, misuse, or breach of these Terms.

4. Products

We make reasonable efforts to accurately describe and display our Products, including images, ingredients, sizes, and prices. However, due to screen display variations, slight differences in color or presentation may occur and do not constitute a defect.

Products are subject to availability. If a Product becomes unavailable after your order is placed, we will inform you as soon as possible and offer a refund, a substitute, or the option to wait for restock.

Some ingredients may cause allergic reactions in sensitive individuals. Please review the ingredient list on each product page before purchasing. Our Products are for external use only and should be used strictly as directed.

5. Prices

All prices displayed on the Site are indicated in euros (EUR) and include applicable VAT unless stated otherwise, based on your delivery location.

Prices do not include shipping fees, which are calculated and displayed at checkout before you confirm your order, nor any customs duties, import taxes, or fees that may apply to international orders (see Section 8).

We reserve the right to change prices at any time. The price applicable to your order is the price displayed on the Site at the time you complete your purchase.

In the event of an obvious pricing error (e.g. due to a technical malfunction), we reserve the right to cancel the order and refund any amount paid, even after order confirmation.

6. Orders

To place an order, follow the steps on the Site: select your Product(s), add them to your cart, provide delivery and billing information, choose a payment method, and confirm your order.

Order confirmation constitutes acceptance of these Terms and creates a binding sales contract between you and ALEGRIA SAS, subject to Product availability and payment validation.

You will receive an order confirmation email summarizing your purchase. Please review it and contact us promptly if any information is incorrect.

We reserve the right to refuse or cancel any order, in particular in cases of suspected fraud, non-payment, abnormal ordering patterns, or a dispute regarding a previous order.

7. Payment

Payment is due in full at the time of order. We accept the payment methods displayed at checkout (e.g. credit/debit card, and other methods as made available).

All online payments are processed through secure, encrypted third-party payment providers. State Of Mind does not store your full payment card details.

Your order will only be validated once payment has been successfully authorized.

8. Delivery

We ship worldwide to the countries listed at checkout. Estimated delivery times are provided for guidance and displayed at checkout or on our shipping information; they are not guaranteed and may vary due to carrier delays, customs processing, or circumstances beyond our control.

Risk of loss or damage to Products passes to you upon delivery to the address provided at checkout.

International orders: for deliveries outside the European Union, additional customs duties, import taxes, or administrative fees may apply upon arrival in the destination country. These charges are the sole responsibility of the customer and are not included in the price paid on the Site. We recommend checking with your local customs authority before ordering.

If a package is returned to us due to an incorrect address provided by the customer or a failure to collect it, we reserve the right to charge the cost of re-shipment.

9. Right of Withdrawal (EU/EEA Consumers) and Voluntary Return Policy

EU/EEA consumers: in accordance with the French Consumer Code (Code de la consommation, Articles L.221-18 et seq.) and EU Directive 2011/83/EU, you have a period of 14 calendar days from receipt of your Product(s) to withdraw from your purchase, without giving any reason.

To exercise this right, notify us before the deadline via our Contact page or by email at contact@stateofmind.fr, then return the Product(s) within 14 days of notifying us, at your own cost, unless stated otherwise.

Condition of returned items: for hygiene and product-integrity reasons, fragrance and cosmetic Products can only be accepted for withdrawal if unopened, unused, and with any protective seal or wrapping intact. Opened or used Products, once the seal is broken, cannot be returned or refunded except in case of a defect or non-conformity, in accordance with applicable law.

Upon receipt and inspection of the returned Product(s), we will refund the price paid (excluding original delivery fees, where legally permitted) within 14 days, using the same payment method used for the original order.

Customers outside the EU/EEA: the statutory 14-day withdrawal right described above may not apply under your local law. Please refer to our Return Policy for the voluntary return conditions we offer in that case.

This Section is a summary; full practical details (return address, process, exceptions) are set out in our Return Policy, which forms an integral part of these Terms.

10. Legal Warranty and Conformity

As a consumer, you benefit from the legal guarantee of conformity (garantie légale de conformité, Articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (garantie des vices cachés, Articles 1641 et seq. of the French Civil Code), regardless of any commercial warranty.

If a Product received is defective, damaged in transit, or does not match your order, please contact us within a reasonable time via our Contact page with photos and your order number, so we can arrange a replacement, repair, or refund as appropriate.

These statutory guarantees apply in addition to, and are not limited by, the voluntary return policy described in Section 9.

11. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, the "State Of Mind" brand, product names, packaging design, photographs, and the overall look and feel — is the property of ALEGRIA SAS or its licensors and is protected by French and international intellectual property laws. No content may be copied, reproduced, distributed, or used commercially without our prior written consent. Full details are set out in our Legal Notice.

12. Liability

We strive to ensure the Site is available, accurate, and secure, but we do not guarantee uninterrupted or error-free access and cannot be held liable for temporary unavailability due to maintenance, technical issues, or events beyond our control.

Our liability for any claim relating to an order is limited to the price paid for the Product(s) concerned, except in cases of gross negligence, willful misconduct, death, or personal injury caused by our negligence, or any liability that cannot be excluded or limited under applicable law.

We are not liable for misuse of Products contrary to the instructions and warnings provided on packaging or on the Site.

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under the mandatory consumer protection laws of your country of residence.
